Hydraulic Fracturing Rulemaking

 

The Board initiated rulemaking to cover certain regulatory aspects of hydraulic fracturing on May 26, 2011, with publication of proposed rules in the Montana Administrative Register ( MAR Notice No. 36-22-157). The following is a link to the rules as proposed in the M.A.R.

Proposed Rules

On June 15 the Board held a Public Hearing at the Richland County Fairgrounds, Commercial Building, Sidney, Montana. The following link is a transcript of that hearing and any written testimony presented at that time.

At its August 11, 2011 business meeting, the Board of Oil and Gas Conservation adopted hydraulic fracturing rules with changes to the proposed rules recommended by its staff as a result of comments received during the public comment period and the public hearing. The following includes the notice of adoption, the changes made to the proposed rules, and the responses to comments received. The Notice of Adoption wiil be published in the Montana Administrative Register on August 26, 2011 and the rules will be effective on August 27, 2011
